Is it illegal for my ex to email nude pics of me?

My bf and I have recently broke up. I have found out tonight that he has sent nude pics of me the he and I had when we were together. He emailed them too all his buddies. Is this illegal for him to do? Could I press charges on him for this?

Reply:Nope, he isn't doing anything illegal unless he is sending them to someone that has told him they don't want them or the people are minors. When you allowed him or whomever to take the pictures, you were giving him permission to use those pictures how he wants. You may be able to take him to court to get him to stop sending the pictures out, but other than that you can't do anything for what he has already done.





Lesson: Don't let people take pictures of you nude.
Reply:1. How old were you when they were taken? If you were under 18, you can get him for disseminating child pornography.


2. If your over 18: If he took this photos, with your consent, they are his property. He has the right to access them for his own private use. He just can't make any money off showing these photos (unless you have signed a consent form). However, once he starts posting them online, or passing them out to his friends, without your consent, you can ask him to stop. You can notify the web serve that he uses of what he's been doing (if it is against their rules to send these types of images). You can contact the police department in your area to see if they can persuade him to knock it off. You'll notice I said "persuade", because he's not breaking any laws. It's not illegal if you were over 18 and willingly agreed to be in the photos, and had knowledge that he had these photos in his possession.


3. For the love of God, don't let people take photos of you that you wouldn't want others to see. I hate to say it, but it's a really horrible lesson to learn the hard way.





Edit: You say that you took the photos. Well, how did he end up with them? If you gave them to him (as a "gift"), then they are his. You essentially transferred ownership of them.
Reply:It depends on where you live but I live in Ontario Canada and here yes this is illegal and yes he could be charged. It is a violation of privacy and he never asked for you permission.. This is so wrong and I am sorry to hear this has happened to you! You should call your local police department and check it out
Reply:You have to be able to prove to the authorities that the photos exist on line. Once done, you can get an injunction against him and sue him for defamation.

If he took the pictures.... with or without your consent he can pretty much do what he wants with them.





Yet another reason to avoid getting naked with people before you know if they are committed to you.
Reply:Legally, pictures are the property of the person who took them.

It is only illegal if you didn't consent to the pictures being taken in the first place. In your case what he did was horrible but not illegal.
Reply:Probably depends on your local laws but I would imagine that if he took the pictures and you agreed to them then ownership of them is his and he can do as he wishes with them.
Reply:Depends on how old you are in them. If you are under 18, it is called child pornography and can get him into some very serious trouble.
